MARS2049.online TERMS OF USE

1.1 Agreement Overview

This Agreement, together with any supplemental terms and policies incorporated by reference, constitutes a legally binding contract between you—whether as an individual or on behalf of an entity ("you")—and MARS2049.online ("MARS2049," "we," "us," or "our"). It governs your access to and use of the Platform and related services, including any distributed applications operating on blockchain networks (collectively, the "Services"). You are solely responsible for ensuring that your use complies with all applicable laws.

1.2 Changes to the Terms

We reserve the right to modify or update these Terms at our sole discretion. If we make material changes, we will provide notice by updating the "Effective Date" at the top of this Agreement and, where practicable, by notifying you via email or through the Platform. Your continued use of the Services after such updates constitutes acceptance of the revised Terms.

2.1 Eligibility

You must be at least 18 years of age—or have reached the legal age of majority in your jurisdiction—to use the Platform. By registering for or using the Platform, you represent and warrant that you meet this requirement.

2.2 Account Registration and Third-Party Logins

To access certain features of the Platform, you may be required to create an account ("Account") or use an authorized third-party login service (e.g., Telegram). By doing so, you authorize us to collect and use certain account information (such as your username, nickname, and profile picture) as provided by the third-party service. You agree to furnish accurate and complete Registration Data and to update such information promptly. You are solely responsible for all activities under your Account and must maintain the confidentiality of your login credentials. Any unauthorized use must be reported immediately.

2.3 Account Suspension or Termination

We reserve the right to suspend, restrict, or terminate your Account, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or unlawful activities, or otherwise compromised the Platform’s security or integrity. In such cases, all virtual currencies or assets associated with your Account may be forfeited, and you will lose further access to the Platform.

3.1 Scope of Services

The Services include an online platform through which you may play games, purchase digital assets, and interact with various applications provided by MARS2049.online. In order to access certain Services, you may be required to connect a compatible digital wallet.

3.2 Virtual Currency

MARS2049.online may provide various forms of virtual currency for in-platform use. These include, but are not limited to:

• Cash (virtual representations only)
• MARS Coin

Such virtual currencies are provided solely for use within the Platform and hold no intrinsic monetary value. They do not constitute legal tender and cannot be exchanged for real-world cash or financial assets outside the Platform.

3.3 Complimentary and Purchased Virtual Currency

Complimentary Virtual Currency: Any free virtual currency provided by the Platform is offered solely for entertainment purposes and remains the property of MARS2049.online. We assume no liability for any loss, expiration, or inaccessibility of such complimentary currency.

Purchased Virtual Currency: Virtual currency acquired through purchase must be used within 180 days of the purchase date ("Usage Period"). Unused currency will expire automatically without compensation. In the event of a loss attributable solely to the Platform within the Usage Period, we may, at our discretion, provide replacement currency on a non-cash basis.

3.4 Redemption and Modification

Virtual currency, whether complimentary or purchased, is strictly for in-platform use. It cannot be redeemed, refunded, or converted into real-world currency. MARS2049.online reserves the right to modify, suspend, or terminate the availability, distribution, or use of any virtual currency, rewards, or incentives without liability.

4.1 Prohibited Activities

You agree not to engage in any behavior that:

• Involves creating multiple accounts to obtain free virtual currency or benefits;
• Attempts to reverse-engineer, decompile, or tamper with the Platform’s code or systems;
• Initiates or attempts to conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks;
• Involves fraudulent, deceptive, or manipulative activities (including misrepresentation or identity theft);
• Interferes with the security or proper functioning of the Platform.

4.2 Security Obligations

You are responsible for safeguarding your Account credentials. MARS2049.online will never request your password or other sensitive personal data directly. Any unauthorized use of your Account should be reported immediately.

4.3 Enforcement

We reserve the right to take appropriate legal action, including account suspension or termination, for any violation of these Terms. All decisions made by MARS2049.online regarding enforcement are final and at our sole discretion.

5.1 Ownership

Unless otherwise indicated, all content on the Platform—including text, graphics, logos, images, and digital assets—is the property of MARS2049.online or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for personal, non-commercial purposes. No portion of the Services may be reproduced or used for commercial purposes without express written permission.

5.2 User Content

Any content you submit ("User Content") remains your property, but you grant MARS2049.online an irrevocable, worldwide, royalty-free license to use, reproduce, modify, and distribute such content for the purposes of providing and improving the Services. You represent that your User Content does not violate any third-party rights.

6.1 Pricing and Payment Terms

Pricing for any items or virtual currency purchased through the Platform will be set forth at the point of sale. All payments must be made in advance and are non-refundable, except as required by applicable law. We may use third-party payment processors; by using our payment services, you agree to their terms and conditions.

6.2 Transaction Fees

Certain blockchain transactions (e.g., Gas Fees) may incur additional charges based on network conditions. You acknowledge that such fees are your responsibility and are final and irreversible.

6.3 Commission and Taxes

For transactions involving smart contracts, MARS2049.online may collect a commission based on the total transaction value. Additionally, if applicable, you are responsible for any taxes associated with your transactions.

7.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR) (or another applicable jurisdiction where specified), without regard to its conflict of law principles.

7.2 Mandatory Arbitration

Any disputes arising out of or related to this Agreement or the Services shall be resolved exclusively by binding arbitration under the rules of the Hong Kong International Arbitration Centre (HKIAC) in English, with arbitration taking place in Hong Kong. You agree to waive any rights to a jury trial or class action.

7.3 Exceptions

Notwithstanding the foregoing, the Platform reserves the right to seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property or proprietary rights.

7.4 Claim Period

Any claim must be brought within six (6) months of the event giving rise to the claim, after which the claim will be barred.

8.1 Entire Agreement

These Terms, together with our Privacy Policy and any other notices posted on the Platform, constitute the entire agreement between you and MARS2049.online regarding your use of the Services and supersede all prior agreements.

8.2 Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

8.3 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time without notice.

8.4 Force Majeure

8.6 Headings and Interpretation

8.7 Survival

The failure of MARS2049.online to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. The provisions of these Terms shall survive any termination or expiration.

9.1 Communications

By using the Services, you consent to receive communications from us via electronic means (e.g., email, push notifications, SMS). Such communications are considered legally effective and form part of your contractual relationship with MARS2049.online.

9.2 User Submissions and Feedback

Any questions, suggestions, or feedback you submit ("Submissions") become our property, and you grant us an irrevocable, worldwide, royalty-free license to use such Submissions in connection with the Services. You acknowledge that we have no obligation to keep your Submissions confidential.

9.3 Third-Party Websites and Content

The Platform may include links to third-party websites or content. MARS2049.online does not control or endorse such sites or content and is not responsible for any losses or damages incurred from your use of them. You access third-party websites at your own risk.
